Divorce

blog-logoThankfully, most people don’t get a divorce more than once in their lives and if they do, the second one is usually less painful than the first.  At least that’s what I’m told by my clients.  As anyone who has been through a divorce will tell you; there are many things you can do on your own in a Colorado divorce. But if you want to reach a fair settlement for the division of marital assets, and do so in the most amicable way possible, it is best to work with a reputable Colorado Springs law firm

blog-logoIt’s amazing how one Time Magazine cover story can get so much attention, but any news magazine is bound to grab headlines when it proclaims that “Marriage is Dead”, and backs that up with a reputable survey.  The big takeaway from this article was that 44 percent of Americans under 30 consider marriage to be obsolete, and according to the same Pew poll, only 5 percent of under-30 set wants to get married; a number that is difficult to fathom when the wedding industry is now $40 billion plus.  As a family law attorney, it’s hard not to question the methodology behind this study, but I know it definitely raised eyebrows among divorce attorneys in Colorado Springs.

blog-logoDividing the marital property may be the most difficult part of getting a divorce, and divorce attorneys in Colorado Springs realize that.  But being a party to a divorce will require swift and decisive action to take care of these matters, especially when the Colorado real estate market is continuously changing.  In many cases, a property settlement will require that the marital home be sold as a means of dividing the property equitably, but with so many homes for sale in Colorado Springs, this may not be so easy.

Make Division of Property Easier

Thursday, 02 December 2010

blog-logoThere is nothing simple about the process of dissolving a marriage, but there are ways to make divorce easier on your self financially.  When it comes time to divide the marital property, real or otherwise, many divorcing couples make costly mistakes that they later regret. Rather than taking on this challenge alone – and all the paperwork that comes with it – it’s smart to look for divorce attorneys in Colorado Springs who have experience in these matters.

blog-logoOne of the most common complaints I hear as a Colorado Springs divorce lawyer is “what am I supposed to do with all this paperwork?”  If you’ve never been through a divorce, then you may have no idea what I’m talking about, so here is some fair warning: Once the paperwork comes rolling in, it doesn’t stop until the final decree is issued.  From the initial petition and praecipe to eventual affidavits and orders, you can expect a never-ending stream of paperwork pertaining to your divorce.

blog-logoWhen you’re facing divorce, it can be very difficult to maintain a positive “can do” attitude, especially if you are trying to do everything by yourself.  Not every divorce requires complete representation from one of the top divorce attorneys, but most people need help with the divorce settlement agreement.  An experienced Colorado Springs divorce attorney knows how to negotiate on your behalf so you end up with an agreement that you can live with.

blog-logoDivorce is never easy, not even when everyone agrees and it is wrapped up quickly. When a divorce is contested, however, things can really start to get ugly.  The top divorce attorneys are often called upon to represent clients in a contested divorce because they know all the best strategies to help their clients get the upper hand.  While there are no surefire ways of “winning” in a contested divorce, there are certain ways that top divorce lawyers will be able to balance the scales in your favor.

blog-logoIf you are considering a divorce in the state of Colorado, there are several choices to make, but the first one will probably be the selection of an experienced divorce attorney.  However, if your first language is Spanish then it is important to look for a Spanish speaking lawyer.  Working with a Spanish speaking lawyer does not mean the lawyer’s first language is Spanish.  They could speak Spanish fluently as a second language, but they must be able to act as an intermediary (and interpreter, if needed) on your behalf.

blog-logoWhen you want to work with an experienced and qualified attorney in Colorado, but your first language is Spanish, it makes sense to look for a Spanish speaking lawyer.  Otherwise, it will be difficult to understand all of the terminology used in the agreements and in court.  Needless to say, this could put you at a severe disadvantage in a divorce proceeding.  Courtrooms are not the place to misunderstand the meaning of what is being negotiated.  It makes a lot more sense to hire a firm that employs Spanish speaking lawyers.

blog-logoIn the state of Colorado, there are many couples who are married by the “common law” but there are no specific laws that cover this kind of marriage.  The only way to prove a common law marriage exists is to state to the court that you live together and that you are known in public as husband and wife.   However, just like a traditional marriage, when a common law marriage ends, it requires a marital settlement agreement.
